California Consumer Rights Form
Being a California resident, you are entitled to certain rights under the California privacy laws. This form is for the purpose of facilitating the Consumers (who are Shufti Pro’s clients; end-users or employees) in the exercise of those rights. It covers the right to access & know what data is being stored and the source of collecting the data; right to have the data deleted; right to have the data corrected, and right to have your data’s marketing as well as sale prohibited. This applies to the Consumer’s data retained by Shufti Pro in the preceding twelve (12) months.
If you are a third party making a request on behalf of the Consumer, Shufti Pro retains the right to verify the representative's identity as well as their authority to act on the Consumer’s behalf. An authorized representative must possess the subject’s signed consent to submit a request on the Consumer’s behalf or provide documentation demonstrating that they have a power of attorney, specifying the same, in accordance with California’s law. If there is a business entity(s) functioning as authorized representatives, and acting on the Consumer’s behalf, it must be legally authorized by the California Secretary of State.
In addition to this, Shufti Pro may contact the Consumer directly as well to verify whether they authorized the said agent/representative.
Response Time:
Upon the receipt of a verifiable request, Shufti Pro shall respond to the client within one (1) month and if need be, up to three (3) months. Any delays or predicaments faced shall be promptly notified to the client.
For those whose data is controlled by a Client and Shufti Pro performs verification services:
Please note that any and all requests pertaining to access; deletion; rectification; marketing & sale of data will be finally settled by the Client and are subject to their approval. Any decision we receive from them shall be conveyed to you promptly. If the Client agrees, your request will be processed. In the event the Client refuses and prohibits us from processing your request for whatever legitimate interests they may cite, you will be kindly directed to contact the Client.
Please note that in certain circumstances, we may not be able to process your request, where the request may, would, or could:
- Contradict a legal obligation owed to our clients;
- Fulfill any regulatory compliance(s) under regulatory law; or
- Prohibit the establishment of a legal defense or exercise of other legal claims.
In such cases, you will be informed promptly with the reasons.
Fees:
This process is void of any types of charges. However, we reserve the right to charge a fee where the application appears to be excessive.
Right to initiate private cause of action:
We are legally obligated to inform you that in addition to reaching out to Shufti Pro, being a California resident you also have a right to initiate a private cause of action.
